  • Reuse of images

The re-use of public information is a use for purposes other than those of the public service mission for the purposes of which the documents were produced or received. This reuse is governed by the code of relations between the public and the administration (CRPA, articles L.300-1 and following).

Any person, whether physical or legal, private or public, is likely to be concerned with the re-use of public information.

The public information contained in documents freely communicable to all and over which third parties do not hold intellectual property rights are only reusable within the meaning of the CRPA. In the event of the presence of intellectual property rights held by third parties, the re-user must obtain the necessary authorizations from the holders of these rights and or their assigns. Without these authorizations, the person who has obtained a copy of a document over which a third party holds intellectual property rights can only make the uses provided for in article L.122-5 of the intellectual property code.

The re-use of information containing personal data is subject to compliance with the legal framework for the protection of personal data. The administration cannot be held responsible for non-compliance with the legal framework by the re-user.

Articles L.324-1 to L.324-5 of the code of relations between the public and the administration fix the principle of free re-use of public sector information. In this context and subject to the indications given above, the archive documents kept by the CLUG Project which are freely available and free of rights can be freely used. The re-user must indicate in the form: © CLUG Project, document code, for any use he makes of the documents.

Failure to comply with the reuse rules exposes the re-user to the sanctions provided for in article L.326-1 of the code of relations between the public and the administration and, in the event of non-compliance with the rules relating to the reuse of data personal, articles 45 and following of the law 78-17 of January 6, 1978 relating to data processing, files and freedoms.

Commercial publishers who wish to publish a large number of documents kept by the CLUG Project in a work are invited to contact the communication and promotion office for their procedures : com.recherche@sncf.fr
